More Miers Blogging

I have to wonder if Bush came up with this nomination while on the bathroom break he was asking about at the UN -- the pause that refreshes and fills seats, one of them on the US Supreme Court.

Previously, in matching excerpts from the Federalist Papers and the John Roberts nomination, I included sections of Number 76 concerning the role of the senate consent: "It would be an excellent check upon a spirit of favoritism in the President... from family connection, from personal attachment..." When we consider that Miers has no experience as a judge and her only qualification seems to be that she's a lawyer -- the President's lawyer -- it sounds the alarms enumerated by Hamilton. Is this appointment in lieu of payment of legal fees? Or the result of genuine trust and confidence? Only the Shadow (and the restroom attendant) know.
